These terms apply to an organisation's use of Witnes Staff, provided by Witness Technologies OPC Private Limited ("we", "us"), Vadodara, Gujarat, India. By creating an account or using Witnes Staff you agree to them on behalf of your organisation, and confirm you have the authority to do so. Individual employees who sign in under an organisation's account use Witnes Staff under that organisation's terms with us.
The service
Witnes Staff provides core HR, time off, attendance, India payroll, expenses, recruiting, onboarding, performance and learning with an approvals inbox. We may improve, change or retire features, and will give notice of a change that removes something an organisation relies on.
Accounts
The organisation's administrators decide who is invited and which role each person has, and are responsible for what happens under the organisation's accounts. Keep passwords private and tell us at once if you think an account has been misused. Give accurate details when you sign up.
Your data
The organisation owns the data it puts into Witnes Staff and remains responsible for having the right to hold it: notifying its employees and candidates, getting any consent the law requires (for example for biometric attendance or location), and answering their requests. We process that data only on the organisation's instructions, as our privacy policy describes. The organisation can export its data at any time.
Payroll and statutory output
Witnes Staff calculates pay, PF, ESI, professional tax, labour welfare fund and TDS from rates and rules that the organisation can see and edit, and produces payslips, registers and files for filing. The organisation must check the rates, rules and output before paying people or filing, and is responsible for the filings it makes and the payments it releases. Witnes Staff is not legal, tax or accounting advice.
Acceptable use
- Use Witnes Staff only for lawful purposes and only to manage people the organisation is entitled to manage.
- Do not put in data you have no right to hold, or use it to discriminate unlawfully, or to monitor people beyond what the law and your own policies allow.
- Do not try to break, overload, probe or get around the security of the service, or to reach another organisation's data.
- Do not copy, resell or build a competing service from Witnes Staff.
Fees
Witnes Staff is in early access. Any fees are agreed with the organisation in writing before they apply, are exclusive of GST, and are payable as agreed. We will not charge for anything the organisation has not agreed to.
Ending the service
The organisation can stop using Witnes Staff at any time and ask us to return or delete its data. We may suspend or end an account that breaks these terms or puts the service or other customers at risk, and will tell the administrators why where we can. We keep only what the law requires us to keep.
Our rights
Witnes Staff, its software and its brand belong to us. We give the organisation a limited, non-exclusive right to use it for its own HR while these terms apply. Feedback you give us may be used to improve the service.
Availability and liability
We work to keep Witnes Staff available and your data safe, but provide the service as it is, and cannot promise it will be uninterrupted or free of errors. To the extent the law allows, we are not liable for indirect or consequential loss, and our total liability is limited to the fees the organisation paid us in the twelve months before the claim. Nothing here limits liability that the law does not allow us to limit.
Law and disputes
These terms are governed by the laws of India. The courts at Vadodara, Gujarat have exclusive jurisdiction.
Changes and contact
We may update these terms; the date above shows the current version, and we will tell account administrators of a material change. Continued use after a change means the organisation accepts it. Questions: info@witnesstechnologies.in.
